  • The U.S. Department of Justice charged Luis David Nino-Moncada with aggravated assault of a federal officer and depredation of federal property, with his initial court appearance set for 1:30 p.m. on Monday, Jan. 12, 2026.
  • During a targeted vehicle stop Thursday, DHS said the driver 'weaponized' his vehicle by striking a Border Patrol car and maneuvering aggressively, prompting an agent to fire.
  • There is no video of the shooting, six U.S. Border Patrol agents were present, at least two rounds hit the driver's side window, and Luis David Nino-Moncada and Yorlenys Betzabeth Zambrano-Contreras were shot and later released from hospital into federal custody.
  • The FBI is leading a criminal probe with the Bureau of Alcohol, Tobacco, Firearms and Explosives assisting, while Oregon Attorney General Dan Rayfield opened a state investigation and protests led to six arrests after calls from Portland Mayor Keith Wilson to halt ICE operations.
  • The shooting has brought renewed scrutiny of federal immigration enforcement, with unclear cooperation between federal authorities and Portland officials, and investigators may refer the case to the Multnomah County District Attorney.
