Jury instructions for "sudden passion"​

Jury instructions included the issue of "sudden passion."

If the jury unanimously finds that the defendant caused the death under the immediate influence of "sudden passion," he may be sentenced for no more than 20 years and no less than 2 years.

If the jury unanimously finds that the defendant did not cause death under the immediate influence of "sudden passion," he may be sentenced to life imprisonment, or no more than 99 years, or no less than 5 years.

In either case, a fine not to exceed $10,000 may also be imposed.

The sentence may also be reduced by parole; however, the defendant is not eligible for parole until the time served equals half of the sentence imposed or 30 years, whichever is less.

The verdict must be unanimous.
 
I can't feel sorry for the dead kid, his own actions lead to his death. He started the altercation, he kept it going when Karmelo told him to leave him alone then he pressed his luck when Melo told him the final warning. He fucked around and found out.
 
I feel bad for both sides.. both young lives lost, too young to realize what a quick mistake or overreaction can do for the rest of their lives. The choosen jury selection damn sure wasn’t gonna help in his favor. Fingers crossed his sentence is on the shorter side and reasonable and he can bounce back and not become another stat/lost soul stuck behind bars for ridiculous sentences.

Nah that wasn't a valid reason for him to lose his life. When it's children having a disagreement the loss of life shouldn't be on the table. I feel for both kids and their families cause it shouldn't have gone that way at all. Everyone lost.
 
Very true but Melo took it to another level by stabbing Austin which I believe is one of the main points

My biggest worry for this kid is mentally his biggest growth in maturity from 18-possibly 30s will be in prison. That's going to be hard to get over when he does get out
 

Jury sentences Karmelo Anthony​

The attorneys and the Metcalf family entered the courtroom, as well as Karmelo Anthony, who is crying and shaking, followed shortly by the judge and members of the jury. Anthony's parents are not in the courtroom.

The 19-year-old was sentenced to 35 years. The jury rejected the sudden passion claim.

Judge Roach will dismiss the jury, and then the victim impact statements will be read.
 
I'm not saying the white boy deserved to die but white people have got to stop disrespecting people's boundaries and their bodily autonomy.

Someone tells you "touch me again and see what happens" isn't an open invitation to see what's going to happen. I fully believe the white kid was antagonizing him but it's just a sad situation all around

Somebody who is much larger than you threaten to beat your ass and his brother also in the vicinity y'all not go poke him as soon as he touch you. In the moment I get why his first instinct was to stab.


Yes I get it but you can’t kill somebody white as a black person and get off free unless you OJ. At least what it seems like
