Karmelo Anthony's mother takes the stand for sentencing phase​

The prosecution and defense both waived opening statements for the sentencing phase of Karmelo Anthony's trial.

The prosecution rested and the defense called Kayla Hayes, Anthony's mother.

"He's my oldest, he's my firstborn," she said. "He will always be my baby. I love him very much."

DEFENSE: Does your son regret what he did?

WITNESS: Yes, he's very sorry for what he did.

The punishment phase of the trial ended after just one witness.
 
It’s all just a shit situation. I personally don’t think there was ever a point where he should have stabbed the kid. The facts of the case and testimony made it an uphill battle for any defense attorney to argue self defense. The race aspect like it or not doesn’t even seem like a major factor until after the fact thanks to.. well society at large.

If this was two black kids we probably never know about this story.
 
Yea I think the force and the "touch me and see what happens" were the big decisions for the jury. Looks like the jury feels he created the situation and so it wasn't self defense

I read that in a few articles that quote was gonna be a big factor. I don't think the case was presented as he created the situation but that he escalated force from what would've been a fight to a stabbing without any immediate reasoning per their pov. That was always the biggest uphill battle for his defense. Proving why he thought his life was in danger
 
I purposely stayed out of this thread because that young man reminds me of my son. My heart goes out to his mom and pops who's going to lose their baby to the system.

RIP to the other kid as well. No parent should lose a child.

The entire thing is a fucked up situation. Also convicted of murder is just crazy this is involuntary manslaughter and that's to high of a charge

By not leaving and then the warning or threat was creating the escalated situation. Seemed like the prosecution wanted to remind the jury of that. Also since witnesses testified that Austin told him he didn't want to fight
 

Jury returns for closing arguments​

The defense and prosecution teams returned to the court, as did Karmelo Anthony, who was visibly shaking in his chair and putting his head in his hands.

"Members of the jury, you have now found Karmelo Anthony guilty of murder and it becomes your duty to assess punishment," Judge Roach said.

PROSECUTOR: Austin Metcalf was a son. Austin Metcalf was a brother ... I'm going to ask you to consider the age of the victim in this case ... Nothing you do with your verdict, nothing you do, will take more from Karmelo Anthony than it did from the Metcalfs ... Austin Metcalf didn't have the opportunity to meet the love of his life, hold a plaque at graduation."

The prosecution showed an image from the track meet of coaches praying over Austin Metcalf at the Frisco ISD track meet last year, saying, "they were praying for healing."

Hunter Metcalf has his hands on his face and is shaking his head.

Addressing social media, the prosecution said they don't know what the jurors know, but said they trust jurors will hold Karmelo Anthony accountable.

Defense makes closing arguments, introduces "sudden passion"​

"We respect your verdict and we respect your role," the defense said to the jury in closing arguments.

"We as Americans trust in our community," the defense said. "I know it's a heavy burden and I know it's a heavy weight you're carrying ... I can only ask you to consider both sides."

The issue of "sudden passion" was brought up, asking them to decide if there was sudden passion in split moment. If [the jury] unanimously believes that in "sudden passion," which means emotion, feeling that is directly caused by provocation, passion arises, then decisions made in the heat of the moment are different.

The defense argues that if [the jury] believes Anthony felt terror in that moment, didn't have time for cool reflection, then sudden passion applies and the burden is on us, but the burden is much lower.

The defense said the video showed "sudden passion."

"This is not about blaming the victim," the defense said. "I ask you to consider both sides."

According to the Texas Penal Code, at the punishment stage of a trial, the defendant may raise the issue as to whether he caused the death under the immediate influence of sudden passion arising from an adequate cause. If the defendant proves the issue in the affirmative by a preponderance of the evidence, the offense is a felony of the second degree.

The sentence can range from 2 to 20 years for sudden passion.
 

Prosecution on "sudden passion"​

Prosecutor Bill Wirskye is addressing sudden passion, saying it is completely inapplicable.

Wirskye says sudden passion is "directly caused by and arising out of provocation by the individual killed." He says that did not happen here.

He said that "adequate cause" does not apply here, meaning a cause that would commonly produce a degree of anger, rage, or resentment.

"This murder," said Wirskye. "This murderer, sudden passion does not apply ... Mercy to the guilty is cruelty to the innocent."

"Life sentences have already been handed down in this case," Wirskye said, talking about the impact to the Metcalf family. "Only a lengthy, lengthy prison sentence is appropriate here ...Your duty is clear. I beg you to do your duty this afternoon ... What you do here sends a message."

Yup.

Can’t threaten bodily harm, that’s assault.

You can only do it.

Even tho this smacks of “what are you gonna do? Shoot me?” And we’ve seen those guys walk free after brandishing.
